By the present application under section 24 of the Civil Procedure Code, the applicant wife is seeking transfer of Marriage Petition No. 90 of 2025, pending on the file of the learned Civil Judge, Senior Division, Baramati, District Pune to the file of learned Civil Judge, Senior Division, Sangamner, District Ahmednagar (Ahilyanagar), for disposal in accordance with law. 3.

On perusal of the record, it appears that the marriage between the applicant and the non-applicant was solemnized on 31.03.2016, however, due to matrimonial dispute, the applicant is residing at her parental house at Sangamner. The learned counsel appearing for the applicant canvassed that the applicant-wife has

no source of income and that it is difficult for her to travel from Sangamner to Baramati to attend the said proceedings at Baramati due to the lack of a direct bus or transport facility. The applicantwife has filed a proceeding bearing Misc. Cri. Application No. 338 of 2023 under the provisions of the Protection of Women from Domestic Violence Act, which is pending on the file of the learned JMFC, Sangamner, whereas, the non-applicant husband has filed proceedings bearing Marriage Petition No. 90 of 2025 before the learned Civil Judge, Senior Division, Baramati, District Pune. 4.

Therefore, considering the nature of dispute and convenience of the applicant- lady, it would be just and proper to transfer Marriage Petition No. 90 of 2025 pending on the file of learned before the learned Civil Judge, Senior Division, Baramati, District Pune to the file of learned Civil Judge, Senior Division, Sangamner, District Ahmednagar (Ahilyanagar), for disposal in accordance with law.

In view of the above discussions, following order is passed:

O R D E R

(1) Misc. Civil application is allowed.

(2) Marriage Petition No. 90 of 2025 pending on the file of

learned Civil Judge, Senior Division, Baramati, District Pune is hereby transferred to the file of learned Civil Judge, Senior Division, Sangamner, District Ahmednagar (Ahilyanagar), for disposal in accordance with law.
