In view of the judgment of the Supreme Court in the case of Kailas Chand Saini Vs. State of Rajasthan, (2013) 2 SCC 298 whenever wilful disobedience of an order of a subordinate court is alleged, the appropriate remedy for such a petitioner is to approach the civil Court, invoking the power under Order XXXIX Rule 2A of the Code of Civil Procedure, 1908. 2.

Hence, keeping the questions raised by the petitioner open to be agitated in such proceedings, the present petition stands disposed of. If such an application is filed, the trial Court shall decide the matter expeditiously.
