By the present application, the applicant / wife is seeking transfer of Petition No.A-118 of 2024, from the file of Family Court Dharashiv (Osmanabad) to the file of learned Civil Judge, Senior Division, Latur.

The learned counsel for the applicant canvassed that on 02.07.2021, the marriage between the applicant and the non-

(( 2 )) 932-MCA-203-2025 applicant was solemnized; however, after some days of the marriage, her husband/the non-applicant developed a habit of consuming liquor and beating her under the state of intoxicant. So also, the applicant has driven from her matrimonial house and then she is residing at her parental house at village Jewali (Takli), Taluka and District Latur and as such, the non-applicant has filed Petition No.A-118 of 2024, seeking decree of divorce. She is unable to attend the Court at Dharashiv (Osmanabad), for want of proper transportation facilities and she is also unable to travel alone. The non-applicant though resisted the application, but no substance is found. Therefore, considering the paramount interest and the convenient of the present applicant / wife, I am of the view that the Petition No.A-118 of 2024, pending on the file of learned Family Court, Dharashiv (Osmanabad), needs to be withdrawn and the same is liable to be transferred to the file of learned Civil Judge, Senior Division, Latur, for disposal in accordance with law.

In view of above, I proceed to pass the following order:-

O R D E R

(i) The Miscellaneous Civil Application is allowed.

(( 3 )) 932-MCA-203-2025 (ii) Petition No.A-118 of 2024, pending on the file of learned Family Court, at Dharashiv (Osmanabad), is hereby withdrawn and transferred to the file of learned Civil Judge, Senior Division, at Latur.

(iii) The copy of this order be submitted to both the Courts. [ Y. G. KHOBRAGADE, J. ] SMS
