Heard learned counsel for the applicant at length. 2.
In spite of service, non-applicant failed to appear. The applicant has filed service affidavit. The applicant also filed service affidavit online on 12.01.2026 along with postal remark that the non-applicant refused to accept the notice. 3.
By the present application, the applicant/wife prays for transfer of Hindu Marriage Petition No. 192 of 2022 from the file of the learned Civil Judge, Senior Division, Shrirampur (1), District Ahmednagar, to the file of the learned Family Court at
(( 2 )) 921(A)-MCA-228-2025 Aurangabad, on the ground that after matrimonial discord, she has started residing at her parental house within the jurisdiction of the Family Court at Aurangabad. The non-applicant has filed Hindu Marriage Petition No. 192 of 2022 seeking a decree of divorce before the learned Civil Judge, Senior Division, Shrirampur (1). 4.
Being a lady, she is unable to travel a distance of 100 km from Aurangabad to Shrirampur. Moreover, she has no source of income and, therefore, is unable to bear the transportation expenses. 5.
On face of record, it further appears that on 28.09.2022, the non-applicant has filed Civil Miscellaneous Application No.314 of 2022 before the learned District Judge-9, Aurangabad, under Section 8 of the Guardians and Wards Act, seeking custody of children and the said petition is transferred to the file of learned Family Court, Aurangabad vide order dated 08.10.2024. Therefore, the nonapplicant is already attending the proceeding before the Family Court, Aurangabad. Hence, he can also attend the proceeding of Hindu Marriage Petition No.192 of 2022 at Family Court, Aurangabad if it is transferred from the file of learned Civil Judge, Senior Division, Shrirampur.

In view of above, I am inclined to grant the present application and proceed to pass the following order:-
O R D E R
(i) The Miscellaneous Civil Application is allowed. (ii) Hindu Marriage Petition No. 192 of 2022, pending on the file of learned Civil Judge, Senior Division, Shrirampur
(1) at Ahmednagar, is hereby withdrawn and transferred to the file of learned Family Court, Aurangabad. (iii) The copy of this order be submitted to both the Courts. [ Y. G. KHOBRAGADE, J. ] SMS
