Heard the Petitioner who appears in-person and learned Senior Counsel for the Respondent.

By this Petition, the Petitioner prays for the following substantive reliefs.

"a) The Petitioner says that he is in the service of Government of India and presently posted as Nautical Officer on deemed deputation to LBS College of Advanced Maritime Studies and Research, Mumbai, a unit of Indian Maritime University. (b) The Petitioner says that though for some years, everything was okay; from 2014 onwards he has been subjected to harassment at the hands of IMU Officials for raising matters of irregularity and corruption in the functioning of IMU. He has also been subjected to mala-fide and discriminatory treatment since then. He was subjected to mala-fide and penal transfer in June 2016. 1/2

INGLE 920-cp-239-25.doc (c) The said transfer order was challenged by the Petitioner as penal, arbitrary and malafide by way of Writ Petition being W.P. No. 6351 of 2016. The Hon'ble High Court, Bombay, found strong prima facie case of arbitrariness, discrimination and mala-fide in the transfer. The said transfer was stayed.

(d) The order of this Hon'ble Court was challenged on behalf of the Indian Maritime University by those at the helm then before the Hon'ble Supreme Court of India by way of Special Leave Petition being SLP No. 22671 of 2016. The said SLP was summarily dismissed by the Hon'ble Supreme Court on 12 August 2016 in view of the facts noted by this Hon'ble High Court." 2.

For the same reasons mentioned in the order passed in Contempt Petition No. 224 of 2024, even the present Contempt Petition is disposed of. It is not possible for us to grant any relief as prayed for by the Petitioner in this Contempt Petition as the only exercise that has to be undertaken by this Court in exercise of the contempt jurisdiction is to ensure the compliance with the order passed by this Court. For the reliefs prayed for in this Contempt Petition, it is open for the Petitioner to resort to appropriate remedies as may be available in law. 3.

It is made clear that it is in the peculiar facts of this case and in view of the directions of this Court that the leave, to the aforesaid extent has been credited to the account of the Petitioner. 4.

Keeping all contentions on merits open, the Contempt Petition is disposed of.
