Despite service, the non-applicant failed to appear in the matter.

By the present application under Section 24 of the Code of Civil Procedure, the applicant / wife is seeking transfer of H.M.P. No. 148 of 2024 under Section 13(1) of the Hindu Marriage Act, filed by the non-applicant seeking decree of divorce and pending on the file of learned Civil Judge, Senior Division,

(( 2 )) 925-MCA-247-2025 Udgir to the file of learned Civil Judge, Senior Division, Kandhar, District Nanded.

On perusal of the application, I have satisfied that the applicant has made out substantial and bona fide grounds for transfer of H.M.P. No.148 of 2024 from the file of learned Civil Judge, Senior Division, Udgir to the file of learned Civil Judge, Senior Division, Kandhar, District Nanded.

In view of above discussion, the present application deserves to be allowed. Hence, I proceed to pass the following order:-

O R D E R

(i) The Miscellaneous Civil Application is allowed. (ii) H.M.P. No.148 of 2024 is hereby withdrawn from the file of learned Civil Judge, Senior Division, Udgir and it is transferred to the file of learned Civil Judge, Senior Division, Kandhar, District Nanded.

(iii) This order be communicated to both the Courts. [ Y. G. KHOBRAGADE, J. ] SMS
