Despite service, the non-applicant failed to appear in the matter.

By the present application under Section 24 of the Code of Civil Procedure, the applicant / wife is seeking transfer of H.M.P. No. 112 of 2024 filed under Section 13(1)(i-a) of the Hindu Marriage Act, filed by the non-applicant, seeking decree of divorce and pending on the file of learned Civil Judge, Senior Division, Ambajogai, District Beed, to the file of learned Family Court at Latur.

On perusal of the application, I have satisfied that the applicant has made out substantial and bona fide grounds for transfer of H.M.P. No.112 of 2024 from the file of learned Civil Judge, Senior Division, Ambajogai, District Beed to the file of learned Family Court, Latur. It is also informed this Court that the non-applicant is attending the cases i.e. Petition E No.72 of 2025 under Section 144 of the B.N.S.S., for maintenance and also Petition A No.112 of 2025 under Section 9 of the Hindu Marriage Act, filed by the applicant for restitution of conjugal rights before the learned Family Court at Latur. 5.
In view of above discussion, the present application deserves to be allowed. Hence, I proceed to pass the following order:-
O R D E R
(i) The Miscellaneous Civil Application is allowed. (ii) H.M.P. No.112 of 2024 is hereby withdrawn from the file of learned Civil Judge, Senior Division, Ambajogai, District Beed and it is transferred to the file of learned Family Court, at Latur.
