Heard the learned Counsel Ms. Kharade, h/f Mr. Karpe, appearing for the applicant at length.

Despite the service, none appears for the non applicant. 3.
By the present application, the applicant prays for transfer of the Misc. Civil Application bearing No. 150 of 2024 from the file of the learned Civil Judge, Senior Division, Satara, District Satara, to the file of the learned Civil Judge, Senior Division, Shrigonda, District Ahilyanagar. 4.
On the face of the record, it appears that on 31.05.2019 the marriage between the applicant and the non applicant was solemnized as per customs and rites prevailing in their society at Shrigonda, District
Ahilyanagar. After the marriage the applicant co-habited with the non applicant at Majalgaon, District Beed. However, due to transfer of the non applicant at Pimpri-Chinchwad, she was staying at Majalgaon and the non applicant was on visiting terms. Out of the said matrimonial relation, the applicant and non applicant blessed with a male child. However, subsequently, due to strain marital relations, the applicant was compelled to stay with her parents at village Shrigonda, where she has already filed a Misc. Civil Application bearing No. 366 of 2022, under Section 125 of the Code of Criminal Procedure. However, the non applicant has filed a proceeding bearing Hindu Marriage Petition No. 150 of 2025 under Section 13 of the Hindu Marriage Act before the learned Civil Judge Senior Division, Satara. Therefore, being a lady, having small child is facing inconvenience to travel from Shrigonda to Satara and unable to attend the proceedings, hence the present application. 5.
The non applicant has not resisted this application as he failed to appear in the matter. Therefore, considering the convenience of the applicant being female, who is nurturing a minor child and facing inconvenience to attend the proceedings at Satara, it will be just and proper to withdraw the Hindu Marriage Petition bearing No. 150 of 2024 from the file of the Civil Judge Senior Division, Satara and transfer the same to the file of the Civil Judge Senior Division, Shrigonda. 6.
Accordingly, the Hindu Marriage Petition No. 259 of 2025 is
allowed.
