Despite service, the non-applicant failed to appear in the matter.

By the present application, the applicant/wife seeks transfer of H.M.P. No. 153 of 2025 from the file of the learned Civil Judge, Senior Division, Aurangabad, to the Family Court at Nanded, on the ground that she is residing at Nanded after the matrimonial relations became strained. However, the nonapplicant has filed the said proceeding before the learned Civil Judge, Senior Division, Aurangabad, due to which she is caused inconvenience in attending the proceedings. Further, she has no

Since the non-applicant did not resisted the application, therefore, it would be just and proper to withdraw H.M.P. No.153 of 2025 from the file of learned Civil Judge Senior Division, Aurangabad and to transfer the same to the file of learned Family Court, Nanded. 4.

In view of above discussion, I am inclined to grant the present application and proceed to pass the following order:-

ORDER

(i) The Miscellaneous Civil Application is allowed. (ii) H.M.P. No.153 of 2025, pending on the file of the learned Civil Judge, Senior Division, Aurangabad is hereby withdrawn and transferred to the file of the learned Family Court at Nanded.

(iii) This order be placed before both the Courts below. (iv) Accordingly, the Miscellaneous Civil Application is disposed off.
