Heard the learned counsel for the applicant and the non-applicant.

By the present application, the applicant / wife is seeking transfer of H.M.P. No.20 of 2025, from the file of learned Civil Judge, Senior Division, Karjat, District Ahmednagar, to the file of learned Family Court, Beed.

In pursuance of the order dated 22.01.2026, the Mediator submitted mediation failure report, which is taken on record and marked as "X" for identification.

Since the mediation is failed, the parties are hereby called upon to argue the matter on merit.

In the case in hand, the marriage between the applicant and the non-applicant was solemnized on 15.02.2021 as per the customs and rites prevailing in their society, at Shriram Mangal Karyalaya, Beed. After the marriage, the applicant cohabited with the non-applicant at her matrimonial house. Initially for some days, there were cordial relations between the applicant and the non-applicant. However, subsequently, there are marital discard between them, which resulted in filing of H.M.P. No.20 of 2025 by the non-applicant before the learned Civil Judge, Senior Divisiion, Karjat, wherein decree of divorce has been sought. The non-applicant has not filed reply and has not denied the contents of application as well. Therefore, considering the law laid down in the case of N.C.V. Aishwarya V. A. S. Saravana Karthik Sha (Civil Appeal No.4894/2022), order dated 18.07.2022, passed by the Hon'ble Supreme Court, it would be just and proper to withdraw the H.M.P. No.20 of 2025 from the file of learned Civil Judge, Senior Division, Karjat and to transfer the same to the Family Court, at Beed.
(( 3 )) 946-MCA-270-2025 However, the non-applicant will be at liberty to appear through video conferencing, if he is unable to attend the proceedings personally at Family Court, Beed.

In view of above discussion, I proceed to pass the following order:-
O R D E R
(i) Miscellaneous Civil Application is allowed.
(ii) H.M.P. No.20 of 2025, pending on the file of learned Civil Judge, Senior Division, Karjat is hereby withdrawn and transferred to the file of learned Family Court at Beed. (iii) The non-applicant is at liberty to appear through video conferencing, if he is unable to attend the proceedings personally at Family Court, Beed.
