In pursuance of order dated 20.02.2026, the Mediator has submitted mediation failure report. It is taken on record and marked 'X' collectively for identification. Since the mediation has failed, the parties are directed to argue the matter on merits.

Heard the learned counsels appearing for the applicant and nonapplicant at length. By the present application under Section 24 of the C.P.C. the applicant/wife is seeking transfer of Marriage Petition No.62/2025 from the file of learned C.J.S.D., Madha, Dist. Solapur to the file of learned C.J.S.D., Jalna. It is not in dispute that on 13.07.2021 the marriage between the applicant and non-applicant was solemnized as per the Hindu customs and rights. Out of said wedlock they are blessed with one daughter namely Kavya

( 2 ) 948 mca 317.25 aged about 2 1⁄2 years. However, due to marital discord the applicant/wife started residing at her paternal house at Partur, Jalna and it is not feasible for her to attend the proceedings before the learned C.J.S.D., Madha Dist. Solapur. Therefore, considering the law laid down in N.C.V. Aishwarya V/s. A.S. Saravana Kartik Sha; 2022 SCC OnLine SC 1199, Sumita Singh vs Kumar Sanjay And Anr.; AIR 2002 SC 396 and Vaishali Shridhar Jagtap V/s. Shridhar Vishwanath Jagtap; AIR 2016 SC 3584, it will be just and proper to withdraw the proceedings from the file of learned C.J.S.D., Madha, Solapur and it be transferred to the file of learned C.J.S.D., Jalna. 3.

Accordingly, the present application is allowed in terms of prayer clause-'C'. No order as to the costs.
