By the present application under section 24 of the Civil Procedure Code, the applicant wife is seeking transfer of Hindu Marriage Petition No.70 of 2024 pending on the file of learned 3rd Joint Civil Judge (S.D.), Shrigonda to the file of learned Family Court, Chhatrapati Sambhajinagar (Aurangabad ). 4.

The learned counsel for the applicant-wife submitted that

the marriage between the applicant and the non-applicant was solemnized on 26.01.2022 as per Hindu customs and rites, and out of the said wedlock, they are blessed with a son, Vishwapratap, on 08.07.2023. The non-applicant is Advocate by profession and practicing at Shrigonda, District Ahilyanagar (Ahmednagar). However, due to matrimonial dispute, the applicant is residing at her parental house at Chhatrapati Sambhajinagar from 22.05.2023. Thereafter, applicant wife has filed proceeding bearing PWDVA No. 420 of 2024 at Chh. Sambhajinagar (Aurangabad), whereas the non-applicant filed proceedings bearing Hindu Marriage Petition No.70 of 2024 before the learned 3rd Joint Civil Judge (S.D.), Shrigonda, District Ahilyanagar. The distance between Shrigonda and Chhatrapati Sambhajinagar is about 150 kilometers, and the applicant wife is facing inconvenience to attend the said proceeding filed by the non applicant husband at Shrigonda.

As per section 24 of the Civil Procedure while transferring a proceedings from one court to another, the convenience of the lady, who is required to attend the proceeding, is required to be considered. Though the non applicant is served with notice, he remained absent. Therefore, considering the

nature of dispute and convenience of the applicant- lady, it would be just and proper to transfer Hindu Marriage Petition No.70 of 2024 pending on the file of learned 3rd Joint Civil Judge (S.D.), Shrigonda to the file of learned Family Court, Aurangabad (Chhatrapati Sambhajinagar) for disposal in accordance with law. 6.

In view of the above discussions, following order is passed:

O R D E R

(1) Misc. Civil application is allowed.

(2) Hindu Marriage Petition No.70 of 2024 pending on the file of learned 3rd Joint Civil Judge (S.D.), Shrigonda is hereby transferred to the file of learned Family Court, Aurangabad (Chhatrapati Sambhajinagar) for disposal in accordance with law.
