Heard Learned Counsel for the Petitioner.

Learned Counsel for the Petitioner submits that the RespondentMIDC has committed contempt of Paragraph 2 of the order dated 11th October 2017. He further submits that the Respondent-MIDC has, even without hearing the Petitioner, decided the representation without any reasoned order, but just by informing the Petitioner that the representation is disposed of, which according to the Petitioner, is not the order passed in accordance with law.

We find that this Court in the order dated 11th October 2017 has directed the Petitioner to make a fresh application for allotment of alternate Plot No.57 in Khanda Colony. If at all the Petitioner is aggrieved by the order passed by the Respondent-MIDC, the remedy for the Petitioner to challenge the said order in appropriate proceedings is always open.

It will also be open for the Petitioner to make a representation to the Respondent-MIDC indicating that he was not heard, which can always be considered by the Respondent-MIDC on its own merits. 5.

Keeping the remedies of the Petitioner open to challenge the order passed by the MIDC, the present Contempt Petition is disposed of. (N.R. BORKAR, J.) (M.S. KARNIK, J.) MMP
