Contempt in the present Petition is alleged for non compliance of order dated 16.12.2024 passed below Exhibit - 6 by the learned Judicial Magistrate First Class, Chiplun, Dist. Ratnagiri. Operative part of said order is at page No.32 of the Petition. Mr.Butala would submit that there is substantial arrears in respect of compliance of interim monthly maintenance amount due to the Applicants and Applicants are finding it extremely difficult especially when Applicant requires to provide care and support to two minor children aged 4 and 6 years. He would submit that there is also non-compliance of order dated 23.03.2021 passed under the DV Act by the learned Judicial Magistrate First Class, Chiplun, Dist. Ratnagiri, appended at page No.43.

An arguable case is made out by Mr. Butala for issuance of notice. Hence issue notice to the Respondent returnable after two weeks. Humdast permitted.

In addition to Court notice, Petitioner is permitted to serve a copy of the Contempt Petition and this order on the Respondent and inform it about the next date of hearing by any permissible mode of service and file appropriate Affidavit of service with tangible proof thereof on or before the next date. 6.

After receiving notice, Respondent is directed to take cognizance of this order and file Affidavit-in-Reply on or before the next date, if so desired.

Respondent is directed to remain present in Court on the next adjourned date.

Stand over to 7th August, 2025.
