Heard learned counsel for the parties.

The order breached is dated 14th June 2024. Paragraph 6 of the order passed by this Court reads thus :- "6. Accordingly, we dispose of the Writ Petition permitting the Petitioner to approach the Education Officer for the claim for B.Ed pay scale. The Education Officer would give opportunity to both, the Petitioner and Management, and pass necessary orders regarding Petitioner's claim. After the Petitioner so applies, the Education Officer will take necessary decision within a period of 12 weeks, subject to earlier time bound public duties, on its own merits."

Learned counsel for the Petitioner submitted that despite specific order of this Court the Education Officer (Secondary), Zilla Parishad has not taken a decision. This Court had indicated that the necessary decision will be taken within a period of 12 weeks, subject to earlier time bound public duties, on its own merits.

Learned AGP requested for some time. Since the Education Officer (Secondary), Zilla Parishad is in breach we were inclined to issue notice and ask him to remain present to explain as to why the order has not been passed within the time stipulated. However, at the request of learned AGP, we are inclined to grant a further period of four weeks from the date of communication of this order to the Education Officer (Secondary), Zilla Parishad to comply with the order dated 14th June 2024. If the decision is not taken within such time by the Education Officer (Secondary), Zilla Parishad, we grant liberty to the Petitioner to revive/file a fresh Contempt Petition and in that case, we may be constrained to call upon the Education Officer (Secondary), Zilla Parishad to remain present.

The Contempt Petition is disposed of.
