The petitioner-society has filed the Contempt Petition alleging wilful disobedience of the undertaking filed by the respondent in furtherance of the order dated 12th March, 2024. According to the petitioner, the undertaking submitted in furtherance of the order dated 12th March, 2024 ought to have included the amount of interest, which the respondent has failed to deposit. Moreover, the decision in the present contempt petition needs to be made without prejudice to the rights of the petitioner to adopt further proceedings in accordance with law.

During the pendency of the present petition, the entire amount as directed under the order dated 12th March, 2024 has been paid by the respondent. Hence, the undertaking has been substantially complied with by the respondent. Once the undertaking has been substantially complied with, the grievance made by the petitioner regarding the failure to deposit interest does not survive, as the order dated 12th March, 2024 is unambiguous and requires the respondent to pay an amount of Rs. 24,75,500/-, which has undisputedly been paid by the respondent during the pendency of this Petition. 3.

Hence, the Contempt Petition need not be proceeded with further. All contentions of both parties are expressly kept open. 4.

The Contempt Petition stands disposed of in the above terms. No costs.
