In this contempt petition the contempt notice was issued to respondent nos. 2 and 3 for committing breach of the terms and conditions of the consent terms which was taken on record on 14th August 2024 in Interim Application No. 6658 of 2024 in Second Appeal No. 330 of 2021. The breach alleged is non-payment of Rs. 20,00,000/- by respondent nos. 2 and 3.

Respondents are served and are represented through advocate. Respondent no.2 is present in the court who is the 1/2

902-CP-564-2025.docx director of the respondent no.1. Respondent no.3 is also the director of respondent no.1. However, learned counsel for the respondents submits that respondent no.3 has now retired. Learned counsel for the respondents has handed over the demand draft of Rs. 20,00,000/- in the name of petitioner no.1. She, therefore, submits that the grievance in the contempt petition would not survive in view of the payment. Learned counsel for the respondents, on instructions, submits that the respondents tender unconditional apology for not complying with the terms and conditions of the consent terms within the stipulated time. She has tendered an affidavit of respondent no.2 which is taken on record. 3.

In view of the payment, it is not necessary to proceed further in this contempt petition. The unconditional apology is accepted. Hence, nothing survives for further consideration in the contempt petition. In view of the aforesaid, the contempt notice issued vide order dated 20th April 2026 stands discharged.

The contempt petition is disposed of in the aforesaid terms.
