We have perused the order dated 29th April, 2024 passed by the Writ Bench, more particularly, paragraph Nos. 6 and 7, which read as under :

"6.

In that view of the matter, we dispose of this petition by directing that the above impugned order will be treated as notice to Petitioners of the proposed ground/s for rejection of Petitioner No. 1's proposal, which stands restored. If there are any other grounds on which the Respondent Education Officer intends to return or reject the proposal, he is directed to communicate the same to the

Petitioners within a period of 3 weeks from today. 7.

The Petitioners shall thereafter submit their explanation to the proposed grounds, along with supporting material including government resolutions, case laws / orders of this Court etc. if relied upon. The Respondent Education Officer is directed to decide the proposal of Petitioner No. 1 thereafter within a period of 8 weeks, by dealing with the explanation given by the Educational Institute as also dealing with case law/orders of this Court, by passing a reasoned order, subject to other time bound directions. The order will be passed as per directions in Nitin Tadge's case, as stated above."

The concerned Education Officer Smt. Dahitule issued a notice of hearing to the Management on 5/7/2024. The Management performed the compliances on 6th May, 2025. She heard the Management. She was transferred on 4th June, 2025. She was succeeded by Mr. Devidas Mahajan. Since this Contempt Petition was listed before us the day before yesterday, Mr. Devidas Mahajan passed an order on ..../11/2025 at 8.30 p.m. The lacunae is that Smt. Dahitule heard the Management and Mr. Mahajan passed the order.

The learned Additional Government Pleader submits on instructions that Mr. Mahajan has realised his mistake and tenders an apology. He submits that the order passed by him shall be recalled forthwith. The Management shall appear in his office on 24th November,

2025 at 11.30 a.m. He would consider the submissions of the Management and the material placed before him. Thereafter, he would pass a reasoned order on or before 31st December, 2025 and shall communicate the order to the Management on its email address within 24 hours. By referring to the above statement, this Contempt Petition is disposed off. However, we record that if the statement made before us is not honoured, we would hold Mr. Devidas Mahajan in aggravated contempt.
