CIVIL APPELLATE JURISDICTION CONTEMPT PETITION NO.710 OF 2025 IN WRIT PETITION NO.8000 OF 2024 Iqbal Burhanuddin Khatib ... Petitioner

.... Respondents **** Adv. Ashish Shukla i/b. Arhat Legal, for the Petitioner. Smt. V. S. Nimbalkar, AGP, for the Respondent-State. Mr. Chandrakant Katkade, Deputy Secretary (Additional Charge), State Information Commission, Nashik Bench and Ms. Vandana Balasaheb Barhate, Tahsil Office, Nashik are present in the Court. **** CORAM :

M. S. KARNIK & S. M. MODAK, JJ.

DATE :

13th FEBRUARY, 2026 P.C. :

1.

Heard learned counsel for the parties.

2.

By the order dated 26th February 2025, this Court disposed of the Writ Petition with the following directions :- "(i) The respondent no. 5 is directed to hear the petitioner and after such hearing pass a reasoned order in accordance with law on the Appeal dated 11 January 2024 pending with the said respondent as expeditiously as possible and not later than within a period of six weeks from the date this order is made available to the said respondent.

Bhogale 906.cp-710-2025.odt (ii) All rights and contentions of parties are expressly kept open. (iii) The petition is disposed of in the above terms. No costs." 3.

Accordingly, by an order dated 23rd April 2025 the concerned Appellate Authority has disposed of the Appeal by a reasoned order.

4.

Learned counsel for the Petitioner submitted that the Respondents have committed a breach of the order inasmuch as the information which was directed to be supplied to the Petitioner has not been furnished despite specific directions of the authorities under the Right To Information Act, 2005. We are afraid that such a relief cannot be the scope of the Contempt Petition. We find that the order passed by this Court is substantially complied with. If the Petitioner is aggrieved by the order dated 23rd April 2025 or seeking compliance thereof, the remedy for the Petitioner is to take recourse to appropriate proceedings in accordance with law but the same cannot be by way of a Contempt Petition. 5.

Keeping the liberty of the Petitioner open to resort to appropriate remedies, the Contempt Petition is disposed of. (S. M. MODAK, J.) (M. S. KARNIK, J.) Signed by: Pradnya Bhogale Designation: PA To Honourable Judge Date: 16/02/2026 10:20:16
