This Contempt Petition has been filed on account of deliberate and willful disobedience/non compliance and continue breach of the order dated 4th September 2025 passed by this Court whereby Respondent No.1 was directed to refund a stamp duty of Rs. 25,64,120/- together with interest thereon @ 6% p.a. from the date of application i.e. 6th April 2023. As per calculation submitted by the Petitioner, the amount therefore due and payable by the contemnor is Rs. 29,72,974/- (including interest amount of Rs. 4,08,854/- as of November 2025). 2.

The learned Counsel for the Petitioner submits that the aforesaid amount has not been paid by Respondent No.1 to them till date and therefore there is a breach of the order dated 4th September 2025. 3.

The learned AGP for the Respondents submitted that they are in the process of filing an SLP before the Apex Court against the order dated 4th

September 2025. She, therefore submitted that this amount would not be payable as the SLP is to be filed. This to my mind is a contention which needs to be rejected inasmuch as there is no SLP as on date filed and there is no stay on the order dated 4th September 2025. Respondent No.1 is therefore obliged to comply with the order dated 4th September 2025 passed by this Court. 4.

The learned AGP, on instructions, submitted a letter dated 1st December 2025 from the office of Respondent No.1, which is taken on record, whereby, Respondent No.1 is to deposit principal amount of Rs. 25,64,120/- to the Petitioner. Respondent No.1 is therefore directed to deposit the amount of Rs. 25,64,120/- within a period of two weeks from today in the Petitioner's bank account, the details of which are as under:- Account Name: Katmandu Apparel Pvt. Further, the interest amount which has been calculated and submitted by the Petitioner in the present Petition to be also deposited after four weeks from the deposit of the principal amount in the bank account of the Petitioner. The learned Counsel for the Petitioner has also submitted that this interest has only been calculated up to November 2025 and his contention insofar as the additional interest which may be payable post November 2025 be kept open. Liberty granted to the Petitioner to raise that contention at the appropriate time. 6.

The learned Counsel for the Respondents submits that in the event they succeed in the SLP proposed to be filed by them before the Apex Court, then Petitioner should refund the principal amount along with interest paid to them. In regard to this, learned Counsel for the Petitioner, on instructions, states that if the Respondents succeed in the SLP proposed to be filed, he will bring back the entire amount i.e. principal amount and interest paid to him in this Court and any further

interest which would have been paid to them. We accept the said statement as an undertaking given to this Court.

List the proceedings on 15th December 2025 for compliance. 8.

By the next date, the Respondents shall place on record a copy of the SLP which they intend to file in the Apex Court (AARTI SATHE, J.)
