Learned Counsel for Respondent Nos.1 to 3, on instructions, submits that Respondents have no objection to transfer the proceedings 2.
In view of the consent, the following order is passed :- : O R D E R :
i) The application stands allowed in terms of prayer clause (a).
ii) Criminal Misc. Application No.316 of 2021, filed under Domestic Violence Act, 2005, clubbed with Divorce Petition No.A-1237 of 2021, stand transferred from the Principal Judge, Family Court at Nagpur to the Principal Judge, Family Rajesh 1/2
56. MCA-31-2025.doc Court at Thane, for hearing and disposal in accordance with law.
iii) The Principal Judge, Family Court at Nagpur, shall transfer the record and proceedings in Criminal Misc. Application No.316 of 2021, filed under Domestic Violence Act, 2005, clubbed with Divorce Petition No.A-1237 of 2021 with such dispatch that it reaches the Principal Judge, Family Court at Thane, within a period of four weeks from the date of communication of this order.
iv) The Respondents are at liberty to appear before the Principal Judge, Family Court at Thane, through Video Conferencing. However, whenever the Principal Judge, Family Court at Thane, considers it appropriate and directs the Respondents to appear in person, the Respondents shall appear before the Family Court at Thane.
v) No costs.
