DATE : 17 FEBRUARY, 2026 P.C. :- 1) By the present Miscellaneous Civil Application, the applicant, wife of the respondent is seeking transfer of the husband'srespondent's petition filed under section 12 of the Hindu Marriage Act from the Family Court, Belapur to the Family Court at Bandra, Mumbai.
2) The respondent is present in Court. Learned advocate appearing for the respondent on instructions from the respondent submitted that considering the physical condition of the applicant, who is now pregnant by eight months, he has no objection if the
2/3 proceedings filed by him are transferred from the Family Court, Belapur to the Family Court, Bandra, Mumbai. He further submits that his client is ready to attend the mediation proceedings if this Court appoints a mediator.
3) Learned advocate appearing for the applicant has instructions from the brother of the applicant who is present in Court, has no objection if the dispute between the parties is referred to the mediation.
4) In view of the same, the present Miscellaneous Civil Application stands allowed in terms of prayer clause (a). 5) The respondent-husband is permitted to appear the court proceedings before the Family Court, Bandra, Mumbai through video conferencing.
6) By consent of both the learned advocates, on instructions of their clients, the dispute between the parties is hereby referred to the Accordingly, Hon'ble Smt. Justice Anuja Prabhudessai, Former Judge of this High Court is appointed as a mediator.
