Heard the learned Counsel for the parties.

The respondent is present before the Court. The respondent states that, he has no objection to transfer the HMP/64/2024 from the Court of Civil Judge, Senior Division, Daund to the Civil Judge, Senior Division, Malshiras. However, the issue of jurisdiction be left open. 3.

The respondent tenders a copy of the un-affirmed affidavit.

In view of the consent of the respondent, the application stands allowed in terms of prayer clause (a). 5.

HMP/64/2024 pending on the file of Civil Judge, Senior Division, Daund, stands transferred to the Court of Civil 1/2

The learned Civil Judge, Senior Division at Daund, shall transfer the record and proceedings in HMP/64/2024 with such dispatch that it reaches the Court of Civil Judge, Senior Division at Malshiras, within a period of four weeks from the date of communication of this order. 7.

Application stands disposed.

No costs.
