This Miscellaneous Civil Application filed by the Applicant-husband under Section 24 of the Civil Procedure Code 1908, seeking transfer of proceedings bearing P.C. No.19 of 2016 pending at Family Court, Bandra and Domestic Violence proceedings case bearing PWDVA No.57 of 2022 pending at learned JMFC, Nashik to Family Court, Nashik 2.

Upon hearing learned Advocate for both the parties, I pass the following Order:

i.

Application is allowed specifically in terms of prayer clause (b).

ii.

The transfer shall be effected within a period of four weeks. Upon receipt of the papers and proceedings, the Family Court, Nashik shall issue notice to the parties, preferably within three weeks, to proceed with their respective matters. iii.

The Family Court, Nashik may, at its discretion, permit the Respondent to appear via Video Conferencing, if such permission is sought and her physical presence is not absolutely necessary. iv.

All concerned to act on an authenticated copy of this Order.
