At the outset, Mr. Pawar, learned Counsel for the Applicant seeks leave to amend prayer clause (a) of the Application. Liberty as prayed for is granted. Amendment to be carried out forthwith. 2.
After this matter was argued for some time, both the learned Counsel, on instructions of their respective clients submit that the present Marriage Petition filed under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights can be transferred and be heard by the Family Court, Thane.

Mr. Pawar, learned Counsel for the Applicant also submits that at present, the Applicant - wife is staying with her Aunty (Mavshi) at Thane. He further submits that there are no issues borne out of the Anand
901. MCA 117-2025.doc wedlock with the Respondent. He submits that he has instructions to submit to this Court that the Applicant is positively thinking of taking mutual consent divorce.

In view of the same, the Application stands allowed in terms of prayer clause (a) and disposed of.

The proceedings, being Marriage Petition No. 222 of 2024 pending before the learned CJSD, Khed, Ratnagiri be transferred to the Family Court, Thane within a period of four weeks from today. (RAJESH S. PATIL, J.) Anand
