DATE : 15 SEPTEMBER , 2025 P.C. :- 1) This transfer application has been filed by the husband, seeking transfer of the domestic violence complaint filed before the 13th Judicial Magistrate First Class at Bhoiwada, Mumbai to the 4th Family Court at Bandra, Mumbai filed by the wife. 2) Apart from the domestic violence complaint filed by the wife, she has also filed a divorce proceedings in the Family Court at Bandra and the husband has filed guardianship (custody) petition for the younger daughter.
3) Both the learned counsels on instructions from their
KVM 2/2 10 - MCA 126 OF 2025.doc clients agree that this Application can be allowed as the wife has no objection to the same transfer the proceedings. 4) Miscellaneous Civil Application is allowed in terms of prayer clauses (b) and (c). The said prayers reads as under :- (b) That this Hon'ble Court be pleased to transfer the entire proceedings of the Domestic Violence Case bearing no. 175/DV/2024 pending before the 13th Metropolitan Magistrate's Court, Dadar since December 2024 to the Hon'ble 4th Family Court, Bandra where the Respondent's divorce proceeding is pending since June 2023 and Guardianship Petition is pending since August 2023.
(c) That this Hon'ble Court be pleased to pass an order to club the Domestic Violence Case bearing no 175/DV/2024 along with the Divorce Petition bearing no A 1758 of 2023 and Guardianship Petition bearing no D-132 of 2024 pending before 4th Court Bandra Family Court, Mumbai.
5) Once the matters are transferred to the 4th Family Court at Bandra, Mumbai, the hearing of the same is expedited. 6) Parties to act on the authenticated copy of this order. [RAJESH S. PATIL, J.]
