1) Learned counsel appearing for the applicant seeks liberty to amend the prayer clause (A) by inserting the words "Civil Judge, Senior Division, Rajgurunagar, District Pune" in place of "Khed Civil Court, District - Pune".
2) Liberty as prayed for, is granted.
3) Amendment to be carried out forthwith.
4) On 9/1/2026, the following order was passed :- 1) By this transfer application filed by the applicant, wife of the respondent seeks transfer of the divorce proceedings filed by the husband before the Civil Judge Senior Division, Khed, Pune to the Family Court at Bandra, Mumbai.
2) It is applicant's case that she is staying with her 4 and 1⁄2 year old daughter at her parents' house in Mumbai. She had filed divorce proceedings in which interim maintenance order has been passed of
Diksha Rane 10 MCA 152 2025.doc Rs.7,500/- to be paid to her and her daughter by the respondent-husband. The respondent-husband is in arrears of the interim maintenance amount. The respondent-husband is the owner of the shop in Pune. He has during the pendency of the present proceedings, illegitimately married another lady and is now a father of one year old son. It is difficult for the applicant-wife to travel to Khed, Pune to attend the Court proceedings. 3) Ms.Shilpa Naik, learned advocate has appeared on behalf of the respondent who is present in Court. She is seeking a short accommodation in order to file her Vakalatnama and also to give an offer of an amicable settlement to the applicant.
4) Stand over to 13 January, 2026. Matter to be treated as a Part Heard.
5) Ad-interim relief granted earlier, if any, to continue till the next date of the hearing.
6) The respondent is directed to remain present on the next date of the hearing.
5) Ms. Naik, learned counsel appearing for the respondent, on instructions from her client submits that present Misc. Civil Application can be allowed. She further submits that entire amount Rs.1,60,000/- which was arrears towards the interim maintenance has been paid. She further on instructions submits that henceforth the respondent - husband would prominently pay monthly maintenance amount in every month without any delay. 6) The statements made by Ms. Naik, on behalf of the respondent - husband is accepted as an undertaking given to this Court. 7) In view of the above, Misc. Civil Application is allowed in terms of prayer clause (A).
8) The proceedings of Divorce Petition No.47/2024 pending before the Civil Judge, Senior Division, Rajgurunagar, District Pune
Diksha Rane 10 MCA 152 2025.doc be transferred to the Family Court at Bandra, Mumbai, within a period of four weeks from today.
9) Learned counsel for the applicant is hereby directed to convey the order passed today to the Civil Judge, Senior Division, Rajgurunagar, District Pune, and file affidavit to that effect within a period of two weeks from today.
10) Similarly, Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the concerned Court by E-mail.
