DATE : 14 NOVEMBER, 2025 P.C. :- 1) Mr.Sohail Mukadam, learned advocate i/b. Advocate Mr.Mayank Samuel submits that he has instructions to appear on behalf of the respondents.
2) Mr. Khan, learned advocate appearing for the applicant submits that the respondents had filed a suit for recovery valued at around Rs.3 crore before this Hon'ble Court. In the said suit, the present applicant being defendant, filed his counter claim valued around Rs.13 crores. He submits that due to change in the pecuniary jurisdiction of the Bombay High Court, all matters where the claim is
KVM 2/2 53 - MCA 180 OF 2025.doc not exceeding Rs.10 crores, were transferred to the City Civil Court at Bombay, pursuant to which the suit filed by the respondents was also transferred to the City Civil Court at Bombay. However, the counter claim being around Rs.13 crores is retained before this Hon'ble Court. He is therefore seeking transfer of the suit filed by the respondents back to this Hon'ble Court and to be heard alongwith the counter claim filed by the applicant.
3) Since due to technical glitch, this court is unable to hear Mr.Mukadam, learned Advocate appearing for the respondents, who is appearing through video conferencing, stand over to 17 November, 2025.
