DATE : 18 NOVEMBER, 2025 P.C. :- 1) By the present transfer proceeding, the applicant, who is the wife of the respondent, is seeking transfer of the marriage petition filed by the respondent under Section 9 before the Joint Civil Judge Senior Division at Dhule to the Family Court at Nashik. 2) The respondent has appeared in person and he has no objection if the proceedings filed by him are transferred from Dhule to Nashik. He has also requested that the DV proceeding which has been filed by the wife before the Judicial Magistrate First Class, Nashik is also be transferred Family Court at Nashik and be also heard alongwith Section 9 petition filed by him.

2/3 3) By consent of both the parties, the following order is passed :- (a) The present Miscellaneous Civil Application stands allowed in terms of prayer clause (A). (b) Similarly PWDV No. 582/2024 pending before the Chief Judicial Magistrate First Class, Nashik be transferred to the Family Court at Nashik and to be heard alongwith the transferred proceeding of Marriage Petition No. 50 of 2025.

(c) Both the proceedings be heard by one and same Judge.

(d) The respondent (husband) has volunteered without prejudice to the rights and contentions of both the parties, to deposit in the bank account of the applicant-wife a sum of Rs.5,000/- per month starting from the month of December 2025. The said amount would be paid every month on or before 5th day of the month.

(e) On the submissions being made by advocate Mr. Khade, appearing for the applicant and the respondent who is appearing in person, the parties are free to approach the Mediation Centre of the District Court Nashik. If the

3/3 parties approach the Mediation Centre of the District Court Nashik, the District Court, Nashik would appoint a trained mediator in order to dissolve before the issue between the parties.
