The Applicants are mother-in-law and sister-in-law of Respondent No.1. They are seeking transfer of the D. V. proceeding filed by the Respondents before the learned JMFC, Pimpri, Pune to the Family Court, Bandra, Mumbai.

The Applicants have filed D. V. Complaints against the Respondent No. 1 on 16.08.2024. Before the said D. V. proceedings could have been filed, the Respondent No. 1 had already filed D. V. Complaints on 22.04.2024 before the learned JMFC, Pimpri, Pune. The Respondent No. 1 has also filed FIR against the Applicants and Respondent No. 1 under Section 498A of the Indian Penal Code, 1860 on 24.02.2024. The distance between the learned JMFC, Pimpri, District - Pune and Family Court, Bandra, Mumbai is 170 Km. The Anand

6. MCA 194-2025.doc Respondent No. 1 is a working lady. As per the Applicants' case, Applicant No. 1 is not working lady and Applicant No. 2 who is the sister-in-law of the Respondent No. 1 is working in I. T. Sector. 3.

Considering facts of the present case where D. V. proceeding filed by the Respondent No. 1, was prior in time and only after four months the present Applicants have filed D. V. proceeding which shows that it was nothing but a counterblast. Hence, I am of the opinion that there is no merit in the present transfer Application. Therefore, the same requires to be rejected.
