DATE : 9 FEBRUARY, 2026 P.C. :- 1) Both the learned advocates submit that the mediation has failed.

2) By the present transfer application, the applicant, wife of the respondent is seeking transfer of the husband's divorce petition pending before the Family Court at Nashik to the Family Court at Pune.

3) Mr.Raut, learned advocate appearing for the respondent - husband, on instructions states that his client has no objection if the present proceedings are transferred.

4) In view of the statement made by Mr.Raut on behalf of his

KVM 2/2 23 - MCA 207 OF 2025.doc client, the present Miscellaneous Civil Applications stands allowed in terms of prayer clause (a).

4.1) The proceedings of Petition No.A381 of 2023 pending before the Family Court at Nashik be transferred within a period of four weeks to the Family Court at Pune.

5) The respondent-husband is permitted to appear before the Family Court at Pune through video conferencing. However, whenever necessary, as per the directions of the learned Family Court, Pune who will be taking up the matter, the respondent will have to attend the proceedings in person.

6) Learned counsel for the applicant is hereby directed to convey the order passed today to the Family Court, Nashik who is hearing the proceedings.

7) Similarly, Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the Family Court, Nashik by E-mail.
