DATE : 18 NOVEMBER, 2025 P.C. :- 1) Office remark shows that the respondent has been duly served.

2) Ms.Gadkari, learned advocate appearing for the applicant submits that on several occasions, the respondent has been served with notice. However, he has chosen not to appear in the present proceeding. She further submits that affidavit of service dated 4 July, 2025 has been filed in the present proceeding. 3) None appears for the respondent when the matter is called out. It seems that the respondent is not interested in opposing the present Miscellaneous Civil Application.

4) By the present transfer proceeding, the applicant, wife of

2/3 the respondent is seeking transfer of the marriage petition filed for dissolution of marriage by the respondent before the Civil Judge Senior Division, Karad to the Civil Judge Senior Division, Junnar, District Pune. It is submitted that the respondent is a renowned surgeon having his hospital at Junnar, District Pune. The applicant is also residing in the same premises, on the first floor where the respondent is residing i.e. at Junnar, District Pune. There are three children out of this wedlock, the elder son is a doctor by profession and is settled in USA. Similarly, the daughter is settled in USA and the younger son is settled in Mumbai.

5) The respondent is a native of Karad. Hence, he has filed the dissolution of marriage petition at Karad which is inconvenient to both, the applicant and the respondent. At page 26 of the present Miscellaneous Civil Application, the prescription sheet of the respondent has been attached. Similarly the ration card of the respondent is enclosed at page no. 29. All these documents show that the respondent is residing and practicing as a doctor (surgeon) at Junnar, District Pune.

6) Having heard Ms.Gadkari, learned advocate for the applicant and after going through the documents on record, I am convinced that this Miscellaneous Civil Application requires to be

7) The present Miscellaneous Civil Application stands allowed in terms of prayer clause (a).

8) The proceeding of Marriage Application bearing No. 101 of 2025 pending before the Civil Judge Senior Division, Karad be transferred within a period of four weeks from today to the Civil Judge Senior Division, Junnar, District Pune. 9) The parties are free to apply to the Civil Judge Senior Division, Junnar, District Pune to prefer an application to attend the court proceedings by virtual mode.

9.1) If any such application is made, the same will be heard on merits.
