The Applicant seeks transfer of Marriage Petition No. A-2865 of 2024, pending before the Family Court at Bandra, to the Family Court at Kolhapur. 2.

The application is primarily on the ground that the distance between Bandra and Kolhapur is approximately 400 kilometers and requires an overnight journey. It is submitted that it would be difficult for the Applicant, being a lady, to repeatedly travel from Kolhapur to Bandra overnight, attend the Court proceedings throughout the day, and thereafter return to Kolhapur Digitally signed by TALLE SHUBHAM ASHOKRAO Date:

The application is opposed on the ground that the Respondent is suffering from stenosis in his lower back, resulting in nerve root compression. 4.

It is further contended that the Applicant has threatened false implication and has treated the Respondent with cruelty. 5.

It appears that the Respondent is suffering from lower back pain. However, it is to be noted that in the present day, facilities such as appearance through video conferencing are available. 6.

Reliance is placed on the judgment of the Hon'ble Apex Court in N.C.V. Aishwarya vs. A.S. Saravana Karthik Sha1, wherein it has been held that while deciding an application for transfer, the convenience of the wife must be given due consideration.

Considering the distance involved and the inconvenience faced by the Applicant, in my view, a case is made out for transfer of the petition. Hence, the following order:

a) Marriage Petition No. A-2865 of 2024, pending before the Family Court at Bandra, is hereby transferred to the Family Court at Kolhapur.

b) The Respondent may appear through video conferencing by making an appropriate request to the Family Court at Kolhapur, 2022 SCC Online SC 1199

subject to availability of such facility.

c) With these directions, the application stands disposed of. [ M.W. CHANDWANI, J. ]
