DATE : 24 DECEMBER, 2025 P.C. :- 1) By the present proceedings the applicant, wife of the respondent is seeking transfer of the divorce proceedings filed by the respondent-husband before the Family Court at Bandra, Mumbai to the Family Court at Kolhapur or to the Civil Judge Senior Division, Kolhapur.

2) It was orally submitted before me that the said divorce proceedings of the respondent-husband be transferred to the Family Court, Kolhapur. So also, the DV proceedings filed by the applicantwife pending before the Judicial Magistrate First Class, Kagal, District

2/3 Kolhapur be also transferred to the Family Court, Kolhapur. 3) Learned advocate appearing for the respondent, on instructions from the respondent-husband who is present in Court submits that he has no objection if such proceedings are transferred and heard by one and the same Judge at Family Court, Kolhapur. 4) In view of the same, the present Miscellaneous Civil Application stands allowed in terms of prayer clause (B). 5) The proceedings of Hindu Marriage Petition No. 1426 of 2024 be transferred within four weeks from Family Court Bandra, Mumbai to the Family Court, Kolhapur.

5.1) The domestic violence complaint bearing No. PWDVA Application No. 2 of 2025 alongwith Criminal Miscellaneous Application No. 12 of 2025 pending before the Judicial Magistrate First Class, Kagal, District Kolhapur be also transferred to the Family Court, Kolhapur.

5.2) Both the proceedings be heard by one and the same Judge.

6) The proceedings before the Judicial Magistrate First Class, Kagal bearing PWDVA Application No. 2 of 2025 alongwith Criminal Miscellaneous Application No. 12 of 2025 be transferred within a period of four weeks to the Family Court at Kolhapur.

3/3 7) The respondent-husband is permitted to attend the court proceedings before the Family Court at Kolhapur through video conferencing. However, whenever necessary, as per the directions of the learned Judge taking up the matter, the respondent will have to attend the proceedings in person.
