DATE : 4 NOVEMBER, 2025 P.C. :- 1) In the present proceedings, this Court by an order dated 25 July, 2025 issued notice to the respondent. Hamdast was permitted. So also, learned advocate for the applicant was granted liberty to serve the respondent through digital mode and private service.
2) Thereafter, since the advocate for the applicant did not take any steps for effecting service on the respondent, cost was imposed on the applicant. The said cost is already been paid. However, the learned advocate for the applicant chose not to take any steps to serve the respondent by permissible modes of service. 3) The transfer proceeding has been filed by the applicant
KVM 2/2 15 - MCA 298 OF 2025.doc wife of the respondent, seeking transfer of the proceedings filed by the husband from Civil Judge Senior Division, Thane to the Civil Judge Senior Division, Junnar. It is the case of the applicant that she is staying with her parents alongwith her 7 years old daughter from the first marriage. Her marriage with the respondent was her second marriage and there are now marital discord. It is further stated that it is difficult for her to travel 180 kms by public transport to attend the court proceedings before the Civil Judge Senior Division, Thane. 4) Issue fresh notice to the respondent, returnable on 2 December, 2025.
5) Apart from the Court notice, the applicant is permitted to serve the respondent by private notice, by all permissible modes of service and file affidavit of service before the next date of the hearing. 6) In the meantime, there will be ad-interim relief in terms of prayer clause (c) till the next date of the hearing.
