DATE : 7 OCTOBER, 2025 P.C. :- 1) After the matter was argued for some time, both the learned advocates for the parties fairly submit that this Miscellaneous Civil Application can be allowed.
2) Miscellaneous Civil Application is allowed in terms of prayer clause (a). The said prayer clause (a) reads as under :- (a) The Hon'ble Court be pleased to transfer the petition for Divorce under sec 13 (1) (i-a) and/or 13 (1) (i-b) under the Hindu Marriage Act 1955 preferred by the Respondent against the Applicant herein in the Hon'ble Civil Judge Senior Division, Court Pune being Marriage Petition No. 809 /2022 be directed to be transfer from Hon'ble Civil Judge Senior Division, Court Pune to the Hon'ble Family Court, Thane.
KVM 2/2 71 - MCA 335 OF 2025.doc 3) The Civil Judge, Senior Division, Pune is directed to transfer the proceedings of Marriage Petition No. 809 of 2022 to the Family Court at Thane within a period of four weeks from today. 4) The respondent-husband is permitted to appear in the transfer court proceedings before the Family Court at Thane by way of video conferencing. However, in case, the learned Judge of the Family Court at Thane wants physical presence of the husband, he would remain present.
5) Hearing of the Marriage Petition No. 809 of 2022 is hereby expedited.
