By the present transfer Application, the Applicant, who is the wife of the Respondent is seeking transfer of the Petition filed under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights by the husband before the Family Court, Thane to the Family Court, Pune.

Mr. Singh, learned Counsel for the Respondent, on instructions of his client submits that his client has no objection, if the present transfer Application is allowed.

In view of the statement made by learned Counsel for the Respondent, the Miscellaneous Civil Application stands allowed in terms of prayer clause (a) and disposed of.

MCA 337-2025 (corrected order).doc 3.1 The proceeding, being the Petition No. A-535 of 2024 pending before the Family Court, Thane be transferred to the Family Court, Pune within a period of four weeks from today. 3.2 The Respondent - husband is permitted to attend the Court proceeding before the Family Court, Pune through video conferencing. However, whenever necessary, as per the directions of the learned Judge taking up the matter, the Respondent will have to attend the proceedings in person.

The Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the Family Court, Thane by Email.

Learned Counsel for the Applicant is hereby directed to convey the order passed today to the Family Court, Thane who is hearing the matrimonial proceedings and file affidavit to that effect within a period of two weeks from today.
