DATE : 8 DECEMBER, 2025 P.C. :- 1) After the matter was argued for some time, both the learned advocates on instructions of their clients fairly submit that the present Miscellaneous Civil Application can be disposed of with transferring the husband's divorce petition pending before the Civil Judge Senior Division, Panvel to the Family Court at Kolhapur and the DV proceedings filed by the wife at Judicial Magistrate First Class, Kolhapur to the Family Court at Kolhapur and both the matters be heard together.
2) The present Miscellaneous Civil Application stands allowed in terms of prayer clause (a).
KVM 2/2 23 - MCA 344 OF 2025.doc 2.1) So also, the proceedings of PWDVA Application No. 56 of 2024 pending before the Judicial Magistrate First Class, Kolhapur be transferred to the Family Court at Kolhapur and the said proceedings be heard alongwith the transfer Hindu Marriage Petition No. 300 of 2024.
3) Both the proceedings to be tagged together and to be heard by one and the same Judge.
4) Hearing of both the proceedings is hereby expedited. 5) Since the respondent-husband is staying at Khopoli, Taluka Khalapur, District Raigad and his parents are not keeping well, he is permitted to attend the court proceedings before the Family Court, Kolhapur through Video Conferencing. However, whenever necessary, as per the directions of the learned Judge taking up the matter, the respondent will have to attend the proceedings in person. [RAJESH S. PATIL, J.]
