DATE : 13 OCTOBER, 2025 P.C. :- 1) This transfer proceeding has been filed by the applicant, husband of the respondent, seeking transfer of two proceedings. viz. (i) petition filed under section 7 of the Guardians and Wards Act and (ii) petition filed under section 125 of the Criminal Procedure Code, seeking maintenance for two children of the applicant and the respondent.
2) After this matter was heard for some time, the respondent Dr.Sadaf Shaikh, appearing through video conferencing and being represented by advocate Mr.Padmasinh P. Patil fairly submitted that this proceeding can be transferred from Nagpur to Mumbai and she be permitted to appear through video conferencing.
2/3 3) By consent, the present Miscellaneous Civil Application is allowed in terms of prayer clause (b). The said prayer reads as under :- (b) Exercise its powers under Section 24 of the Code of Civil Procedure, 1908, and issue appropriate directions and orders thereby transferring the proceedings bearing Petition No. D-56 of 2022 (filed under Section 7 of the Guardian and Wards Act, 1890 read with Section 7(l)(g) of the Family Courts Act, 1984), and Petition No. E-328 of 2022 (filed under Section 125 of the Code of Criminal Procedure, 1973), currently pending before the Learned Judge, Family Court No. 4, Nagpur, to the Learned Family Court at Bandra, Mumbai;
3.1) Petition no. D-56/2022 alongwith Petition No. E-328 of 2022 be clubbed and heard together by one and the same judge before the Family Court, Bandra, Mumbai.
3.2) The said proceedings be transferred within a period of four weeks from today by the Family Court at Nagpur. 3.3) Hearing of both the petitions is hereby expedited and in any case and considering the fact that both are doctors by profession, hearing of both the proceedings is expedited and in any case to be heard and disposed of on or before end of March 2027. 3.4) Also considering that both, the applicant and the respondent are doctors by profession, they are permitted to attend the proceedings through video conferencing and whenever the court is of
3/3 the view that the presence of the parties are physically required in court, the parties will attend physically in the court. 3.5) Both the parties undertake to this Court that they will not seek any unnecessary adjournment in the proceeding and will cooperate in the early disposal of the proceedings.
