Heard learned counsel for the Applicant. Nobody appears on behalf of the Respondent, though duly served.

By the present Application, the Applicant seeks transfer of Hindu Marriage Petition No.134 of 2025 pending before the learned Civil Judge, Senior Division at Tuljapur to learned Civil Judge, Senior Division, Karmala, District Solapur.

Contention raised is that, the Applicant is living at the mercy of her parents and is suffering from neurological disorder and she is undergoing treatment for the same. It is also contended that, one Criminal M.A. No.194 of 2025 filed by the Applicant against the Respondent is also pending before the learned Judicial Magistrate First Class at Karmala. Shailaja

Since nobody appears on behalf of the Respondent, the contention made by the Applicant about her treatment remained uncontroverted. Further as held by the Hon'ble Apex Court in case of N.C.V. Aishwarya Vs. A.S. Saravana Karthik Sha1, convenience of the wife is required to be taken into consideration while considering transfer of case. 5.

Since proceedings under Protection of Women from Domestic Violence Act, 2005 are already going on in the court of Karmala and considering inconvenience of the Applicant to attend the proceedings at Tuljapur, it will be appropriate to transfer Marriage Petition No.134 of 2024 pending before Civil Judge, Senior Division at Tuljapur to the learned Civil Judge Senior Division, Karmala, District Solapur. 6.
