CORAM : RAJESH S. PATIL, J.

DATE : 30 JANUARY, 2026 P.C. :- 1) Not on board. Taken on board.

2) This matter has been moved by the learned advocate appearing for the applicant-husband, seeking the clarification of order dated 1 October, 2025 passed in Miscellaneous Civil Application No. 389 of 2025.

3) According to me, there is no need for any clarification in paragraph no.1 of the order dated 1 October, 2025, since in specific terms, it has been mentioned 'subject to'.

4) It is also clarified that both the parties should comply

KVM 2/2 praecipe 1 - MCA 389 OF 2025.doc with the order dated 13 May, 2024 passed by the Family Court. 5) The order dated 13 October, 2025 was passed when the advocate appearing for the respondent-wife was not ready to continue appearing for the respondent. Hence, the respondent had appeared in person and this Court had directed the Legal Aid Committee of the High Court, Bombay to appoint an advocate from the Panel to appear on behalf of the respondent-wife. Therefore, as a matter of interim arrangement, in order to put to quietus, the issue about "access", this Court had noted the statement of respondent-wife in paragraph no.5 of the order dated 13 October, 2025. However, this Court had not made any changes or interfered in the order passed by the Family Court dated 13 May, 2024.

6) Praecipe is disposed of.
