DATE : 1 DECEMBER, 2025 P.C. :- 1) Mr.Burad, learned advocate appearing for the applicant, on instructions from his client seeks leave and liberty to withdraw the present Miscellaneous Civil Application and file a fresh Miscellaneous Civil Application as and when his client desires to file the same. 1.1) Liberty as prayed, is granted, with leave to file fresh Miscellaneous Civil Application as and when the situation arises. 2) The present Miscellaneous Civil Application accordingly stands disposed off as withdrawn.

3) The dispute is between the applicant and respondent nos.

Both of them have agreed that a Parsi Priest can be appointed as a mediator to resolve the dispute between them and also the dispute with their eldest brother. 4) Accordingly Ervad Yazdi Aibara, Karani Agiary, is appointed as a Mediator to make an attempt to resolve the dispute between the parties.

5) The parties are hereby directed to contact the learned mediator and forward him the ordinary copy of the order passed today in the present proceedings.
