DATE : 4 FEBRUARY, 2026 P.C. :- 1) Mr.Vedant Bende, learned advocate appearing on behalf of the respondent on instructions from his client submits that his client has no objection if the present Miscellaneous Civil Application is allowed.
2) The present Miscellaneous Civil Application stands allowed in terms of prayer clause (a) which reads as under :- (a) This Hon'ble Court may be pleased to transfer the Marriage Petition (A) Nos. 479 of 2025 filed by the Respondent under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights against the Applicant from Hon'ble Family Court, Thane to the Hon'ble Family Court at Bandra, Mumbai;
KVM 2/2 32 - MCA 440 OF 2025.doc 3) The proceedings of Marriage Petition (A) No. 479 of 2025 be transferred within four weeks from Family Court, Thane to the 7th Family Court, Bandra, Mumbai and the same be heard alongwith Divorce Petition No. A-74 of 2025. Both the petitions be heard by one and the same Judge.
3.1) The hearing of both the petitions is hereby expedited. 4) The respondent-husband is permitted to attend the Court proceedings by video conferencing before the Family Court, Bandra, Mumbai. However, whenever necessary, as per the directions of the learned Family Court, Bandra, Mumbai, taking up the matter, the respondent will have to attend the proceedings in person. 5) Both the parties undertake that they will co-operate with the learned Judge in disposing of the petitions at the earliest and will not seek unnecessary adjournments.
6) Learned counsel for the applicant is hereby directed to convey the order passed today to the Family Court, Thane who is hearing the proceedings.
7) Similarly, Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the Family Court, Thane by E-mail.
