1) Ms. Saldhana, learned counsel appearing for the applicant seeks liberty to amend the prayer clauses (a) and (b) of the Misc. Civil Application.
2) Liberty as prayed for, is granted.
3) Amendment to be carried out forthwith.
4) By the present transfer application, the applicant - wife of the respondent is seeking transfer of the respondent - husband's divorce proceedings filed before the Principal Judge, Family Court at Sangli to the Family Court at Thane.
5) Mr. Nikam, learned counsel appearing for the respondent - husband, on instructions of the respondent - husband, who is present
Diksha Rane 18 MCA 448 2025.doc in the Court has no objection if present Misc. Civil Application is allowed, and the proceedings are transferred to the Family Court at Thane.
6) In view of the statement made by learned counsel appearing for the respondent-husband, on instructions of the respondent - husband, present Misc. Civil Application stands allowed in terms of prayer clauses (a) and (b).
7) The proceedings of the Marriage Petition No.A-490/2020 pending before the Principal District Judge, Family Court at Sangli be transferred to the Family Court at Thane within a period of four weeks from today.
8) Similarly, the proceedings of the Domestic Violence Application No.407/2023 pending before the Judicial Magistrate First Class, Thane, be transferred to the Family Court at Thane. 9) Both the proceedings be heard by one and the same Judge. 10) The respondent-husband is permitted to attend the proceeding before the Family Court at Thane, through video conferencing. However, whenever necessary, as per the directions of the learned Judge taking up the matter, the respondent will have to attend the proceedings in person.
Diksha Rane 18 MCA 448 2025.doc 11) Learned counsel for the applicant is hereby directed to convey the order passed today to the Principal Judge, Family Court at Sangli, so also, to the Judicial Magistrate First Class, Thane, and file affidavit to that effect within a period of two weeks from today. 12) Similarly, Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the concerned Courts, by E-mail.
