IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION MISCELLANEOUS CIVIL APPLICATION NO. 457 OF 2025 Rohan Anant Pankhurde ..Applicant

Versus

ANAND SUDHAKAR SUDAME Madhura Mohan Rane ..Respondent Mr. Vaibhav Parab, Advocate, for the Applicant by ANAND SUDHAKAR SUDAME Date:

2026.03.11 18:03:07 +0530 CORAM : RAJESH S. PATIL, J.

DATE : 25.02.2026 P. C.

1.

Mr. Parab, learned Counsel for the Applicant has, mentioned this matter by way of an urgent praecipe.

2.

By an Order dated 28.01.2026, the Misc. Civil Application was disposed of, subject to payment of cost of Rs.50,000/- to be paid to the Respondent within a period of four weeks.

3.

After hearing Mr. Parab, I cautioned him that if he argues the matter further, the cost imposed in the earlier Order would be increased. Mr. Parab still went on arguing the matter and stated that the issue of cost should be removed from the Order dated 28.01.2026. After some time, I again cautioned Mr. Parab that costs will be increased, however, he still chose to make submissions against the learned Advocate who had appeared for the Applicant on the earlier Anand

4.

After hearing him further, I am not convinced, since the allegations being made are against the Counsel who had appeared for the Applicant on earlier occasions.

5.

Hence, further costs needs to be imposed on the Applicant for wasting judicial time when several of litigants are awaiting their turn. 6.

Thus, the cost imposed by the Order dated 28.01.2026 is further increased by Rs. 25,000/-.

7.

Therefore, the total cost of Rs.75,000/- to be paid by the Applicant to the Respondent within a period of two weeks from the date of uploading of this order.

8.

Accordingly, the praecipe stands disposed of. (RAJESH S. PATIL, J.) Anand
