Mr. Mhatre, learned Counsel for the Applicant seeks leave to amend prayer clause (a) of the Application by inserting the words "may kindly be transferred".

Leave as prayed for is granted.

Amendment be carried out forthwith.

By the present transfer Application, the Applicant, who is the wife of the Respondent is seeking transfer of the Petition filed under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights by the husband before the Family Court, Nagpur to the Family Court, Pune.

Learned Counsel for the Respondent, on instructions of his client submits that the Respondent has no objection, if the present transfer Application is allowed.

In view of the statement made by learned Counsel for the Respondent, on instructions of his client, the Miscellaneous Civil Application stands allowed in terms of prayer clause (a) and disposed of.

The proceeding, being the Marriage Petition No. A-1148 of 2025 pending before the Family Court, Nagpur be transferred to the Family Court, Pune within a period of four weeks from today. 8.

The Respondent - husband is permitted to attend the proceeding before the Family Court, Pune through video conferencing. However, whenever necessary, as per the directions of the learned Judge taking up the matter, the Respondent will have to attend the proceedings in person.

At this stage, both the learned Counsel jointly make a request that the dispute between the parties can be referred to the District Legal Services Authority (for short "DLSA"), Pune so as to enable them to appoint a trained mediator to make an attempt to resolve the dispute between the parties.

If an Application is preferred by either of the parties to the DLSA, Pune, the Secretary, DLSA, Pune to appoint a trained mediator in the present proceeding in order to make an attempt to settle the dispute between the parties.
