It appears that petitioner is alleging contempt not on the ground of willful disobedience of the order but on the ground that incorrect information has been furnished in reply by the Investigating Agency before the High Court dealing with criminal matter.

The counsel for petitioner submits that on 31st June, 2021 the proceeding filed against the applicant was stopped under Section 258 of the Code of Criminal Procedure and all the accused therein including the petitioner came to be discharged. This proceeding arose out of Crime No.6/2018 for the offence punishable under Section 135 of the Bombay Police Act. 3.

It appears that in Criminal Writ Petition No.915/2024 the Investigating Officer in reply referred to Crime No.6/2018. This reference according to the petitioner is contempt of Court. 4.

I do not find substance in the aforesaid submission. It is a fact that Crime No.6/2018 was registered against the petitioner. Its a different matter that the said proceeding was dropped and petitioner discharged. That by itself will not mean that Crime

In any case the aforesaid averment cannot be said to be willful disobedience of order dated 31st July, 2021 passed by the Court below. That being so, there appears no merit in the petition. 6.

The petition is dismissed.
