The present contempt petition is filed contending that by refusing to grant compassionate appointment to Petitioner No.5, who is son of Appellant in Appeal No.27/2023, the respondents have committed contempt of Clause (5) of the operative portion of the judgment and order dated 27.01.2025 passed by the learned School Tribunal, Amravati in Appeal No.27/2023, reads as under : (5) The respondent No.1 and 2 are directed to send proposal to the respondent No.3 to get pensionary and other service benefits of the deceased appellant to his family as per law."

The contention is that refusal to grant compassionate appointment amounts to denial of service benefits. The entitlement to compassionate appointment cannot be adjudicated in a contempt petition. The contempt petition is, therefore, dismissed, reserving the liberty to the petitioners to take recourse to appropriate legal process. (ROHIT W. JOSHI, J.) Gulande Signed by: A.S.
