This Court, vide order dated 4/2/2025 passed in Writ Petition No. 7025/2024, wherein the challenge was raised to the declaration that the Petitioner is unfit for the post of Constable in CRPF on account of 'Nevus Depigmentosus', as indicated in the medical examination report, has held that such declaration cannot be sustained, and accordingly, it was quashed and set aside. This Court directed the Respondents to consider the candidature of the Petitioner for the post of Constable in CRPF, if otherwise there is no any impediment in that regard.

Mr. Chaudhari, the learned Counsel for the Respondents has drawn attention of this Court to the pursis dated 14/3/2026 stating that the Petitioner will have to undergo medical

It is further made clear that in the said medical examination they will not consider the earlier ground which has already been held as not sustainable i.e. the earlier finding recorded to declare the Petitioner as unfit on account of 'Nevus Depigmentosus'.

The directive issued on 7/4/2014 as regards conduct of fresh medical examination on initial joining also stipulates medical re-examination after one year of the joining. Though in the present case the Petitioner was not allowed to join because he was found unfit for the above referred reason, however, the period of more than one year is lapsed in between, and therefore, considering the post on which the Petitioner is seeking appointment, we do not find any unreasonableness in asking the Petitioner to undergo medical examination.

Thus, the submission of the learned Counsel for the Respondents is accepted to the extent that, save and except the earlier ground, on which the Petitioner was declared unfit, a fresh medical examination shall be conducted.

Accordingly, the Petitioner shall appear for medical re-examination within one week from today.

The Petitioner shall communicate the date of his

List this matter after two weeks.
