After hearing the matter for sometime, when this Court expressed disinclination, the learned Advocate for the revision petitioner sought instructions from the revision petitioner and upon instructions, makes a statement that the revision petitioner does not press the Civil Revision Application, provided the respondent does not press for mesne profits. Mr. Chandurkar, learned Advocate for the respondent, on instructions from the respondent, states that in the event peaceful vacant possession is delivered on or before 31.12.2026, the respondent will not press for mesne profits.

Mr. Sudame, learned Advocate for the revision petitioner, makes a statement on instructions that the revision petitioner shall vacate the suit property and hand over peaceful vacant possession thereof to the respondent on or before 31.12.2026 and that an affidavit to this effect, in the nature of undertaking to this Court, will be filed on or before 27.02.2026. Revision Application is disposed of as
54.cra.18.2026.odt withdrawn. Time till 31.12.2026 is granted to the revision petitioner to vacate the suit property and deliver vacant possession thereof to the respondent subject to condition that affidavit as aforesaid will be filed before this Court on or before 27.02.2026.

In the event, such affidavit is filed within the stipulated period and possession of the suit property is delivered to the respondent on or before 31.12.2026, the respondent will not be entitled to claim mesne profits. (ROHIT W. JOSHI, J.) C.L. Dhakate
